The General Contracting Conditions regulate the distance selling relationship between INTIMO & MEDIAS SL and the user or client, according to the legal stipulations, especially the Act 7/1998 of April 13, about General Contracting Conditions, Act 3/2014 of March 27, which modifies the revised text of the General Consumer and User Protection Act (Ley General para la Defensa de los Consumidores y Usuarios), Organic Law 3/2018 of December 5, on the Protection of Personal Data (Ley Orgánica de Protección de Datos Personales) and guarantee of digital rights, General Data Protection Regulation (Reglamento General de Protección de Datos) (EU) 2016/679, Act 7/1996 of January 15, about Retail Trade Regulation (Ordenación de Comercio Minorista) and Act 34/2002 of July 11, about Information Society Services and Electronic Commerce (Servicios de la Sociedad de la Información y de Comercio Electrónico).

INTIMO & MEDIAS SL reserves the right to make the changes it considers appropriate, without prior notice about the General Conditions. Such modifications may be made, through its websites, by any means admissible by law and will be mandatory during the time they are published on the website, and until they are validly modified by subsequent ones. However, INTIMO & MEDIAS SL reserves the right to apply, in certain cases, some Particular Contracting Conditions in preference to these General Conditions when it is considered appropriate, announcing them in a timely manner.

The duration of the contract will be linked to the delivery of the product without prejudice to the right of withdrawal. When the amount of a purchase has been charged fraudulently or improperly using a payment card number, their holder may demand the immediate cancellation of the charge. In such a case, the corresponding debit and repayment entries in the accounts of the supplier and the holder will be made as soon as possible. However, if the purchase had actually been made by the cardholder and the refund requirement was not a consequence of having exercised the right of withdrawal or resolution and, therefore, had unduly demanded the invalidation of the corresponding charge, the former will be obliged before INTIMO & MEDIAS SL to compensate the damages and losses caused as a result of the previously mentioned annulment.

PURCHASE ORDER EXECUTION

INTIMO & MEDIAS SL commits to deliver the order in a maximum of three to five business days, from the day following the order. The availability of the products offered by INTIMO & MEDIAS SL may vary depending on customer demand. Despite the fact that INTIMO & MEDIAS SL updates the stock periodically, the product requested by the client could be out of stock at that moment. In the event of non-execution due to unavailability, INTIMO & MEDIAS SL will notify the client by email as soon as it becomes aware of this situation. The period of this communication will not exceed in any case the maximum period of 30 days. INTIMO & MEDIAS SL may give the double option of: supplying the client, without a price increase, a product with similar characteristics or of superior quality, or except for justified and demonstrable reasons by INTIMO & MEDIAS SL within this same period, paying the sums paid for the order that has been cancelled.

RIGHT OF WITHDRAWAL

The buyer will have a period of fifteen calendar days to withdraw, from the day the customer receives the product, without any penalty and without indicating the reasons whatsoever.

RETURN

The client must return or deliver the product directly at INTIMO & MEDIAS SL, to the address LONJA STREET, 1 POLÍGONO INDUSTRIAL PISA, 41927, MAIRENA DEL ALJARAFE, SEVILLE, without improper delay, and in any case within a maximum period of fifteen calendar days from the date on which the right to withdraw regarding the contract is formalized. The term will be understood to have been met if the customer returns the product before the end of the term. The customer will be responsible for the costs of returning the product.

PAYMENT REFUND

The reimbursement of the amounts received by the client will be made using the same means of payment used by the client. INTIMO & MEDIAS SL may withhold the refund until the product has been received.

RETURN OF DEFECTIVE PRODUCT

In the event that the product is not in good condition and the causes attributable to it are not a consequence of the customer, they will have the right to return the product, informing INTIMO & MEDIAS SL of the reason for returning it through any of the means provided in these general contracting conditions.

JURISDICTION

Similarly, INTIMO & MEDIAS SL reserves the right to present civil or criminal actions that it considers appropriate for the improper use of its website and contents or for breach of the present conditions.

The relationship between the user and the provider will be ruled by current regulations and applicable in Spanish territory. If any controversy arises, the parties may submit their conflicts to arbitration or go to the ordinary jurisdiction, complying with the rules on jurisdiction and competence in this regard. INTIMO & MEDIAS SL is domiciled in MADRID, Spain.
